1. AGREEMENT TO TERMS
These Terms & Conditions (“Terms”) form the agreement between you (“Participant”, “Client”, “You”) and:
Wyld Tribe Pty Ltd / Tracy McFie
including all associated brands, events, programs, retreats, offerings, websites and experiences including but not limited to:

TracyMcFie.com
-
Sistahood Rising
-
retreats and pilgrimages
-
live events and festivals
-
workshops and activations
-
online courses and masterclasses
-
memberships and mentoring containers
-
digital products and educational materials
By purchasing, registering for, attending, participating in, or accessing any offering, you acknowledge that you have read, understood, and agreed to these Terms.

2. DEFINITIONS
“Company”
Refers collectively to Tracy McFie, Wyld Tribe, Sistahood Rising, affiliated contractors, facilitators, employees, volunteers, representatives and associated entities.
“Programs”
Refers to all services, events, retreats, festivals, mentorships, coaching containers, memberships, workshops, online trainings, digital products and experiences offered by the Company.
“Events”
Refers to all live or online experiences including retreats, immersions, festivals, masterminds, ceremonies, workshops and activations.
“Digital Content”
Includes all downloadable or streamed material including videos, PDFs, meditations, recordings, workbooks, graphics, educational content and online portals.

3. ELIGIBILITY & PARTICIPANT RESPONSIBILITY
By participating in any Program or Event, you confirm that:

you are over 18 years of age;
-
you are legally capable of entering into a binding agreement;
-
you take full responsibility for your own physical, emotional, mental and spiritual wellbeing;
-
you understand that transformational work can be emotionally activating;
-
you participate voluntarily and at your own discretion.
You acknowledge that all decisions, actions and outcomes arising from your participation remain entirely your responsibility.

4. PAYMENTS
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Payment may be made via:
-
full payment;
-
payment plan;
-
third-party finance provider;
-
subscription or recurring billing arrangement.
By entering a payment plan, you agree to complete all scheduled payments for the full term of the agreement.
Failure to complete participation does not remove your financial responsibility.

5. PAYMENT PLANS
Where a payment plan is selected:
-
payments must be made on the agreed dates;
-
you authorise the Company to process scheduled payments using your nominated payment method;
-
declined payments may incur additional processing or administration fees;
-
overdue accounts may result in suspension of access to Programs, Events or Digital Content.
If payments remain overdue for more than 14 days, the full remaining balance may become immediately payable.
The Company reserves the right to engage debt collection services where necessary.

6. REFUNDS & CANCELLATIONS
Due to the energetic preparation, administration, limited capacity and digital access associated with our Programs and Events, all purchases are generally non-refundable unless otherwise required under Australian Consumer Law.

Digital Products & Online Programs
No refunds are provided for:
-
change of mind;
-
lack of participation;
-
scheduling conflicts;
-
failure to complete the Program.

Retreats, Festivals & Live Events
Deposits are non-refundable.
If you cancel:
-
more than 90 days prior to the Event, payments made may be transferred to a future offering at the Company’s discretion;
-
within 90 days of the Event, no refunds will be issued.
You are responsible for any personal travel or accommodation costs associated with cancellations.

7. TRANSFERS & CREDITS
Where approved by the Company, payments may be transferred to another Program or Event.
Credits:
-
are non-transferable unless approved in writing;
-
must be used within 24 months;
-
cannot be redeemed for cash.
The Company reserves the right to refuse transfer requests at its discretion.

8. EVENT, RETREAT & FESTIVAL CONDITIONS
The Company reserves the right to:
-
modify schedules;
-
change facilitators or venues;
-
reschedule Events;
-
cancel Events where necessary;
-
refuse entry or remove Participants whose behaviour is disruptive, unsafe or harmful.
No refunds will be issued for removal due to inappropriate behaviour, harassment, aggression, intoxication, illegal substances or breaches of community standards.
Participants are responsible for:
-
travel insurance;
-
medical insurance;
-
passports/visas;
-
personal belongings;
-
transportation and accommodation unless explicitly included.

9. HEALTH, WELLNESS & SPIRITUAL DISCLAIMER
The Programs and Events offered by the Company are educational and transformational in nature.
They are not:

medical advice;
-
psychological treatment;
-
psychiatric care;
-
financial advice;
-
legal advice;
-
therapy or crisis support services.
Our work may include:
-
meditation;
-
breathwork;
-
embodiment practices;
-
somatic exploration;
-
emotional processing;
-
spiritual concepts and energetic modalities.
Participation may evoke emotional responses.
You acknowledge that you participate voluntarily and assume full responsibility for your wellbeing before, during and after participation.
If you have any medical, psychiatric or physical condition that may impact your participation, you agree to seek professional medical advice prior to engaging in any Program or Event.

10. PERSONAL RESPONSIBILITY
You acknowledge that:

transformation is subjective;
-
results vary between individuals;
-
no guarantees are made regarding personal, emotional, relational, spiritual or financial outcomes.
Your success depends on your own participation, decisions, commitment and personal circumstances.

11. MEDIA RELEASE
By attending any Event or Program, you grant the Company permission to use photographs, video, audio recordings or testimonials featuring you for:

marketing;
-
promotional materials;
-
social media;
-
websites;
-
future event promotion.
If you do not wish to appear in media content, you must notify the Company in writing prior to the Event.

12. INTELLECTUAL PROPERTY
All content provided by the Company remains the intellectual property of Tracy McFie / Wyld Tribe unless otherwise stated.
This includes:
-
training materials;
-
frameworks;
-
branding;
-
recordings;
-
graphics;
-
processes;
-
meditations;
-
presentations;
-
course content;
-
event materials.
You may not:
-
reproduce;
-
share;
-
distribute;
-
teach;
-
sell;
-
copy;
-
modify;
-
republish
any Company content without prior written permission. Unauthorised use may result in legal action.

13. CONFIDENTIALITY & COMMUNITY CONDUCT
Participants agree to maintain confidentiality regarding personal information shared by other Participants during Programs or Events.
The Company maintains a zero-tolerance policy for:
-
bullying;
-
harassment;
-
discrimination;
-
hate speech;
-
abusive conduct;
-
disruptive behaviour.
We reserve the right to remove any Participant who compromises the safety or integrity of the space.

14. ONLINE COMMUNITY & MEMBERSHIP ACCESS
Access to online portals, memberships, Telegram groups, Facebook groups or digital communities is conditional upon respectful participation.
The Company may suspend or revoke access where community standards are breached.
Membership subscriptions may renew automatically unless cancelled prior to the next billing cycle.

15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company is not liable for:

personal injury;
-
emotional distress;
-
business loss;
-
indirect loss;
-
travel disruptions;
-
technological interruptions;
-
loss of data;
-
participant decisions or outcomes.
Liability is limited to the amount paid directly to the Company for the relevant Program or Event.

16. FORCE MAJEURE
The Company shall not be held responsible for delays, changes or cancellations caused by circumstances beyond reasonable control including:

natural disasters;
-
pandemics;
-
government restrictions;
-
venue closures;
-
travel interruptions;
-
illness;
-
acts of God;
-
technical outages.
Where possible, Events may be rescheduled or converted to online delivery.

17. INDEMNITY
You agree to indemnify and hold harmless Tracy McFie, Wyld Tribe, Sistahood Rising and all associated representatives against any claims, damages, liabilities, losses or expenses arising from:
-
your participation;
-
your conduct;
-
breach of these Terms;
-
negligent or unlawful actions.

18. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law that cannot legally be excluded.
Where liability cannot be excluded, liability is limited to the resupply of services or the amount paid for the relevant service.

19. GOVERNING LAW
These Terms are governed by the laws of Western Australia, Australia.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.

REFUND POLICY
GENERAL POLICY
Due to the nature of transformational, educational, experiential and digital offerings, all sales are generally final.
Please choose carefully before purchasing.
We do not provide refunds for:
-
change of mind;
-
scheduling conflicts;
-
failure to attend;
-
lack of participation;
-
dissatisfaction based on personal expectations;
-
personal circumstances outside the Company’s control.
RETREATS + INTERNATIONAL JOURNEYS
Retreat deposits are strictly non-refundable.
If cancellation occurs:

More than 90 days prior:
Payments may be transferred to another offering at Company discretion.
Within 90 days:
No refunds will be issued.
Within 30 days:
No transfers or credits will be issued.
Travel insurance is strongly recommended.
FESTIVALS + LIVE EVENTS
Tickets for Sistahood Rising and other live events are non-refundable.
Tickets may only be transferred if approved in writing.
The Company reserves the right to alter:
-
schedules;
-
venues;
-
presenters;
-
lineups;
-
event format.
These changes do not constitute grounds for refund.
DIGITAL PRODUCTS + ONLINE PROGRAMS
Due to immediate access to intellectual property and digital materials:
-
all digital sales are final;
-
no refunds are provided once access has been granted.

PARTICIPANT WAIVER + ASSUMPTION OF RISK
By participating in any Program, Event, Retreat, Festival or Experience offered by the Company, you acknowledge and agree:

you participate voluntarily;
-
you are responsible for your own wellbeing;
-
you understand emotional and physical responses may arise;
-
you release the Company from liability associated with your participation;
-
you understand these experiences are not a substitute for medical or psychological care.
You accept full responsibility for your choices, actions and outcomes before, during and after participation.
You agree to seek appropriate medical or psychological support where required.

MEDIA CONSENT
By attending any Event or Program, you consent to the recording and use of:

photographs;
-
video;
-
audio;
-
testimonials;
-
social content.
These materials may be used for:
-
marketing;
-
promotional campaigns;
-
social media;
-
websites;
-
future educational or commercial purposes.
If you do not wish to appear in media, you must notify the Company in writing before the Event begins.

Nothing contained within our websites, programs, events or content constitutes:
